Terms of Use

Article 1 (Purpose)

The purpose of these terms is to set out the conditions and procedures for use of the online services provided on the website (hereinafter the ‘site’) operated by Golden Diamant Plastic Surgery Clinic (hereinafter the ‘clinic’), and the rights·obligations and responsibilities of the clinic and the user.

Article 2 (Definitions)

1. The ‘site’ means the website operated by the clinic for the purposes of providing medical information, receiving consultations, giving reservation information and the like.
2. A ‘user’ means a member or non-member who accesses the site and uses the services in accordance with these terms.
3. A ‘member’ means a person who has registered as a member of the site and may continue to use the services.
4. A ‘non-member’ means a person who uses the services provided by the site without registering as a member.

Article 3 (Publication and amendment of the terms)

1. The clinic publishes the content of these terms on the initial screen of the site so that users may check it easily.
2. The clinic may amend these terms to the extent that they do not violate relevant legislation such as the Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilisation and Information Protection.
3. Where the terms are amended, the effective date and the reason for the amendment are stated and announced on the site from seven days before the effective date. In the case of an amendment unfavourable to users, it is announced from 30 days before.
4. Where a user does not agree to the application of the amended terms, the user may stop using the services and request withdrawal of membership.

Article 4 (Provision of services)

The services provided by the clinic through the site are as follows.

1. Provision of information on medical departments and procedures
2. Receipt of and reply to online consultations
3. Information on medical appointments
4. Viewing of before · after surgery photographs by members
5. Clinic news and event information

Article 5 (Suspension of the provision of services)

1. The clinic may temporarily suspend the provision of services where grounds such as repair·inspection·replacement of equipment or a communications failure arise.
2. Where there are grounds of force majeure such as a natural disaster or a national emergency, the services may be restricted or suspended.
3. Except where suspension occurs for reasons that could not be foreseen in advance, the clinic announces the reason for and duration of the suspension on the site.

Article 6 (Membership registration and loss of eligibility)

1. A user applies for membership registration by entering information in the registration form prescribed by the clinic and agreeing to these terms.
2. The clinic may refuse an application falling under any of the following, or may terminate the use agreement subsequently.
   • Where the name of another person has been used
   • Where there is falsehood, omission or error in the registered content
   • Where the use of the services by other users has been obstructed or relevant legislation has been violated
3. A member may request withdrawal at any time, and the clinic will process it without delay. However, records relating to medical treatment that must be retained under relevant legislation such as the Medical Service Act are retained for the period prescribed by that legislation.

Article 7 (Obligations of the user)

Users must not carry out the following acts.

1. Registering false content when applying or making changes
2. Misappropriating the information of another person
3. Infringing the intellectual property rights, including copyright, of the clinic or a third party
4. Damaging the reputation of the clinic or a third party or obstructing their business
5. Disclosing or posting on the site obscene or violent content or other information contrary to public order and morals

Article 8 (Management of postings and copyright)

1. Copyright in the content published on the site, including text, photographs, diagrams and video, belongs to the clinic, and users may not reproduce·transmit·publish·distribute·broadcast it or allow a third party to use it without the prior consent of the clinic.
2. Where the clinic judges that content posted by a user falls under any subparagraph of Article 7, it may delete or move it without prior notice.
3. Before · after surgery photographs are disclosed only to members in accordance with the Medical Service Act, and may not be leaked externally or used without authorisation.

Article 9 (Notice concerning online consultation)

1. The online consultation provided on the site is for the purpose of providing general information and guidance on visiting the clinic, and does not replace examination·diagnosis·prescription by a doctor.
2. Precise diagnosis and the decision on a treatment method are always made through an in-person consultation after visiting the clinic.
3. The treatment information and cases published on the site may produce different results according to each individual's condition, and the same result is not guaranteed for every user.
4. Side effects may occur with medical procedures; please make your decision after receiving a full explanation from the medical team in charge before treatment.

Article 10 (Protection of personal information)

The clinic protects users' personal information in accordance with relevant legislation such as the Personal Information Protection Act, and the specific details are set out in a separate privacy policy.

Article 11 (Obligations of the clinic)

1. The clinic does not carry out acts prohibited by legislation or by these terms, and endeavours to provide the services continuously and stably.
2. The clinic maintains a security system for the protection of users' personal information, and publishes and complies with its privacy policy.
3. Where the clinic recognises an opinion or complaint raised by a user as justified, it handles it appropriately; where immediate handling is difficult, it notifies the reason and the schedule for handling.

Article 12 (Exemption from liability)

1. The clinic is exempt from liability where it cannot provide the services owing to a natural disaster or comparable force majeure.
2. The clinic bears no liability for obstruction of the use of the services caused by grounds attributable to the user.
3. The clinic bears no liability for the reliability or accuracy of information posted on the site by users.

Article 13 (Resolution of disputes)

1. The clinic and the user shall make every necessary effort to resolve amicably any dispute arising in connection with the services.
2. Where, notwithstanding the efforts under paragraph 1, litigation is brought, the court of jurisdiction shall be as prescribed by the Civil Procedure Act.

Supplementary provisions

These terms apply from the effective date.
